I want a hero

I need a hero so I have the science studied, the tavern built, I have 50000 gold, I have some free men for building and I have 12 black gems when I only need 10 to proceed. Why can't I get my hero?

You need to be a captain (2*) to hire a hero.
No black gems are required.
